UAE Inheritance Law

In the UAE, the legal system which governs personal and family matters, including inheritance is divided into two streams: Shariah law, for Muslims, and non-Shariah law (Civil Law), which applies to non-Muslims.

For Muslims, Shariah law specifies inheritance distribution. Key points include:

Son vs. Daughter: A son typically receives double the share of a daughter.
Spousal Rights: A surviving spouse is entitled to a portion of the estate, dependent on the presence of children or other relatives.
Entitlements: Other relatives, such as parents and siblings, may also have specific claims to the estate.

For non-Muslims, the UAE has introduced specific provisions for inheritance, intestacy and the drafting of Wills, which do not follow the above framework.

Protecting your Assets

It’s not nice to think about, but should you die, you want your assets to go where you want them – Yungo Law can help with Will Drafting and Estate Planning. Without these in place, things could end up in a legal tangle that might not align with your wishes.

For Dubai non-Muslim expats, you can register a DIFC Will that will allow you to distribute assets as you please, bypassing intestacy laws. In Abu Dhabi, whether you’re Muslim or not, provided you are a non-UAE national, an ADJD Will is a similar option.

These Wills can be drafted so your assets are given out according to your wishes, bypassing intestacy law. You will have independence over the distribution of your assets and achieve a more internationally recognised approach.

Guardianship Will

If you haven’t heard of a Guardianship Will, it’s a game-changer for parents. This legal document lets you choose a Guardian for your children, should something happen to you. Think of it like an insurance policy for their well-being, providing stability during tough times. Having an Interim Guardian named in the event of your death provides immediate care and support for your child or children while arrangements are made for the Permanent Guardian to take over.

Without a registered Will or specific instructions appointing Interim and Permanent Guardians for your children, the UAE local authorities would have to intervene and take care of them, until the Courts approval of a suitable Guardian.

Family Law, Including Mediation

Navigating the complexities of family law, particularly during emotionally charged situations like divorce, can be challenging. It encompasses a wide range of legal issues that can deeply affect your personal and financial well-being, including:

Divorce and Separation: The dissolution of a marriage involves complex legal, financial, and emotional considerations. A skilled family lawyer can provide invaluable guidance, ensuring that your rights are protected and that the process is conducted with fairness and equity. Where possible, mediation can offer a collaborative approach to resolving disputes, helping both parties reach mutually agreeable terms without the need for lengthy court battles.

Child Custody and Visitation: Determining child custody arrangements is often one of the most emotionally charged aspects of family law. A knowledgeable lawyer can help you navigate the legal framework for custody and visitation, advocating for the best interests of your children. Mediation can also play a crucial role in fostering cooperation between parents, creating a stable and supportive environment for the children.

Spousal Support and Alimony: Whether you are seeking or contesting spousal support, having a strong legal advocate can ensure that your financial interests are represented effectively and fairly. Mediation can provide a constructive platform for negotiating support terms, reducing conflict and promoting a more amicable resolution.

Division of Assets and Debts: During divorce proceedings, the equitable division of marital assets and debts is a critical aspect of achieving a fair resolution. A skilled family law lawyer can help protect your financial interests and ensure that all relevant factors are considered. Mediation can also be a valuable tool in reaching a balanced and mutually acceptable division of property.

Benefits of Mediation

Family Mediation is an affordable, efficient, and amicable process used to navigate family law disputes in a conciliatory way. This alternative dispute resolution method involves an independent, family law-trained professional who assists you by collaboratively working through any differences to reach a resolution. Mediation helps preserve relationships, saves time, and reduces costs, making it an ideal option for resolving disputes outside of court.
