As parents juggling a million things at once, thinking about the future for your family tends to take a back seat. Then, when the universe finally gives you a moment to do some “adulting”, picking the right law firm is a big decision.

Yungo Law understands the importance of safeguarding your assets, securing your family’s future and handling family law matters. They can arrange everything from Wills drafting, Estate Planning, and Family Law, including divorce, offering peace of mind and expert guidance during those critical moments in life.

Will Drafting

It’s not nice to think about, but should you die, you want your assets to go where you want them – Yungo Law can help with Will Drafting and Estate Planning. Without these in place, things could end up in a legal tangle that might not align with your wishes.

UAE and Shariah Law

In the UAE, things operate a bit differently with the legal system being influenced Shariah law, which is in charge of various aspects of personal and family matters, including inheritance.

In Shariah law, a son gets double the share of a daughter, and a surviving spouse gets a portion of the deceased’s estate. The exact percentage depends on factors like the presence of children, parents or other relatives. Other relatives like parents and siblings may also have specific entitlements to percentages of the estate.

It sounds complicated but this is something Yungo Law can help you navigate.  Put simply, by applying Shariah law principles to Wills and inheritance can significantly impact estate planning, so the UAE introduced specific provisions to allow expats to draft Wills which are compliant to their personal beliefs

Protecting your Assets

For Dubai non-Muslim expats, you can register a DIFC Will that will allow you to distribute assets as you please. In Abu Dhabi, whether you’re Muslim or not (and your home country doesn’t follow Shariah law), an ADJD Will is a similar option.

These Wills can be drafted so your assets are given out according to your wishes, bypassing the Shariah based inheritance law. You will have independence over the distribution of your assets and achieve a more internationally recognised approach.

Guardianship Will

If you haven’t heard of a Guardianship Will, it’s a game-changer for parents. This legal document lets you choose a Guardian for your children, should something happen to you. Think of it like an insurance policy for their well-being, providing stability during tough times. Having an Interim Guardian named in the event of your death provides immediate care and support for your childor children while arrangements are made for the Permanent Guardian to take over.

Without a registered Will or specific instructions appointing Interim Guardians for your children, the UAE local authorities would have to intervene and take care of them, until the Courts approval of a suitable Guardian.

Family Law, Including Divorce

Navigating the complexities of family law, particularly during emotionally charged situations like divorce, can be challenging.  It’s made up of a wide range of legal issues that can deeply affect your personal and financial well-being, including:

   – Divorce and Separation: The splitting of a marriage involves complex legal, financial, and emotional considerations. A skilled family law lawyer can provide invaluable guidance, ensuring that your rights are protected and that the divorce process is conducted with fairness and equity.

   – Child Custody and Visitation: Determining child custody arrangements is often one of the most emotionally charged aspects of family law. A knowledgeable lawyer can help you navigate the legal framework for custody and visitation, advocating for the best interests of your children.

   – Spousal Support and Alimony: Whether you are wanting or contesting spousal support, having a strong legal lawyer can ensure that your financial interests are represented effectively and fairly.

   – Division of Assets and Debts: During divorce proceedings, the equitable division of marital assets and debts is a critical aspect of achieving a fair resolution. A skilled family law lawyer can help protect your financial interests and ensure that all relevant factors are considered in the division of property.

Yungo Law offers compassionate and strategic legal help to guide you through divorce proceedings, child custody disputes, spousal support and other family law matters. They will always prioritise amicable resolutions and strive to minimise conflict, but are also prepared to advocate fiercely for your rights when necessary. Their goal is to empower you to make informed decisions while providing the support and representation you need during difficult times.
